Acceptance and eligibility

These Terms of Use ("Terms") govern your access to and use of the Kiskadees personal finance platform, including our marketing website, web application, API, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding agreement. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time; material changes will be communicated as described in the final section of this document.

Service description

Kiskadees is a personal finance platform that helps you organize accounts, track transactions, set budgets and goals, import financial data, and gain visibility over your finances. Features may vary by plan and are subject to change as we improve the product.

The Service is provided for personal, non-commercial financial organization unless otherwise agreed in writing. Kiskadees is not a bank, broker, investment advisor, tax advisor, or payment institution. We do not hold customer funds, execute trades, or provide individualized financial, legal, or tax advice.

Information displayed in the Service is based on data you provide or import. You are responsible for verifying the accuracy of your financial records and for decisions you make based on information shown in the Service.

Accounts and security

To use most features, you must register an account with accurate and complete information and keep your credentials confidential. You are responsible for all activity that occurs under your account, whether authorized or not.

You must notify us promptly at support@kiskadees.com if you suspect unauthorized access, loss of credentials, or any security incident affecting your account. We may suspend or require verification steps when we detect suspicious activity.

We implement reasonable security measures, but no system is completely secure. You agree to use a strong, unique password and to log out from shared or public devices.

Free and paid plans

Kiskadees offers a free plan with core features and a paid plan (Kiskadees Complete) with additional capabilities. Plan features, limits, and pricing are described on our pricing page and may change with reasonable notice.

Paid subscriptions are processed by Stripe. By subscribing, you authorize recurring charges according to the billing interval you select (monthly or annual). Prices may be shown in your local display currency; the charge processed by Stripe is subject to Stripe's terms and applicable taxes.

Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You may cancel at any time through your account settings or by contacting support@kiskadees.com. Cancellation stops future charges; access to paid features generally continues until the end of the current paid period. Refunds are handled according to our refund policy and applicable consumer protection laws.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not misuse the Service, interfere with its operation, attempt unauthorized access, scrape or harvest data, reverse engineer components except as permitted by law, or use the Service to transmit malware or harmful content.

You must not use the Service to launder money, commit fraud, violate export controls, infringe intellectual property, harass others, or process data you do not have the right to use. We may investigate violations and cooperate with law enforcement where required.

We reserve the right to remove content, restrict features, or suspend accounts that violate these rules or pose risk to the Service or other users.

Intellectual property

The Service, including software, design, logos, trademarks, documentation, and content we provide, is owned by Kiskadees or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of the Service or our intellectual property.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes during your subscription or free use period.

You retain ownership of the financial data and content you submit. You grant us a license to host, process, and display that data solely to provide and improve the Service, as described in our Privacy Policy.

Limitation of liability

The Service is provided "as is" and "as available" to the maximum extent permitted by law. We do not warrant uninterrupted, error-free, or completely secure operation. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.

To the fullest extent permitted by applicable law, Kiskadees and its affiliates, directors, employees, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service.

Our aggregate liability for claims relating to the Service shall not exceed the greater of (a) the amounts you paid to Kiskadees in the twelve months before the claim, or (b) one hundred U.S. dollars (USD 100), except where liability cannot be limited under mandatory consumer protection law.

Termination

You may stop using the Service and delete your account at any time through account settings or by contacting support@kiskadees.com. Upon termination, your right to access the Service ends, subject to any paid period already in effect.

We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, create legal or security risk, or if we discontinue the Service with reasonable notice where feasible.

Provisions that by their nature should survive termination — including intellectual property, limitation of liability, governing law, and dispute-related terms — will remain in effect.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where mandatory consumer protection rules of your province or territory of residence require otherwise.

If you are a consumer in Canada or another jurisdiction with mandatory local protections, nothing in these Terms limits rights you cannot waive by contract under applicable law, including rights under applicable provincial consumer protection legislation.

Any dispute arising from these Terms or the Service shall first be addressed by contacting support@kiskadees.com. Where required by law, disputes may be submitted to the competent courts of your province or territory of residence if you qualify as a consumer under local law.

We aim to respond to support requests within a reasonable timeframe. For subscription or payment issues processed through Stripe, we may need to coordinate with Stripe's systems while resolving your request.

Official notices regarding these Terms may be sent to the email address associated with your account or published on our website with an updated effective date.
